Commentary on Article 91 of Regulation of Communist Party of China on Disciplinary Actions(Illegal Handling of Weddings, Funerals and Other Celebration Activities)

《中国共产党纪律处分条例》第91条规定了党员违规操办婚丧喜庆事宜的违纪行为、适用处分种类及处分幅度。违规操办婚丧喜庆事宜是违反党的廉洁纪律的行为,侵害和违反了党员干部职务的廉洁性和社会主义道德,违纪主体包括全体党员,主观状态表现为故意,具体包括利用职权或职务影响操办婚丧喜庆事宜,在社会上造成不良影响,借操办婚丧喜庆事宜之机敛财,以及在操办婚丧喜庆事宜中有其他侵犯国家、集体和人民利益行为的三种情形。实践中,认定本类违纪,应当把握婚丧喜庆事宜的范围、利用职权或者职务上的影响、在社会上造成不良影响及从重或加重处分情形的内涵,灵活运用监督执纪四种形态,有效处理党员违规操办婚丧喜庆事宜行为。违纪的同时存在职务违法,涉嫌刑事犯罪的,应当依法追究其法律责任。

Article 91 of the Regulation of Communist Party of China on Disciplinary Actions stipulates the disciplinary violations,applicable types of punishment and the range of punishment for party members’illegal handling of weddings,funerals and other celebration activities.Illegal handling of weddings,funerals and other celebration activities is an act against the integrity and discipline of the Party,which infringes and violates the integrity discipline and socialist morality of the positions of party members and cadres.The main body of discipline violation includes all party members.The subjective state is intentional.This kind of violation specifically includes three situations:taking advantage of power or position to influence the handling of weddings,funerals and other celebration activities,causing adverse effects in the society;making money by taking advantage of the handling of weddings,funerals and other celebration activities;and other misconducts to violate the interests of the state,the collective and the people in handling weddings,funerals and other celebration activities.In practice,to identify this kind of violation of discipline,we should define the scope of the weddings,funerals and other celebration activities,the influence of using power or position,the connotation of causing adverse effects in society and heavier punishment,flexibly use the four forms of oversight over discipline compliance,and effectively disposal the misconduct of party members in handling wedding and funeral celebrations.If the violation of discipline is accompanied by the violation of duty and is suspected of criminal offence,the legal responsibility shall be investigated according to the law.
