中国海洋水质安全规制体制问题研究

Research on the Regulation System of Sea Water Quality Safety in China

海洋水质安全对维护生态系统完整、人类健康具有重要意义。中国入海河流水质较差,近海海洋生态遭到破坏,体现出海洋水质安全规制存在一定问题。本文通过比较,研究发现中国海洋水质安全规制存在立法修订滞后、不够重视公众参与,"多头规制"、协调困难,水质标准宽松、更新滞后,对海水污染行为处罚机制不合理等问题,从而提出完善中国海洋水质安全规制体制建议。

The safety of marine water is of great significance to maintaining the integrity of the ecosystem and maintaining human health.The water quality of China's rivers entering the sea is poor,and the coastal marine ecology has been destroyed,which shows that there are many problems in marine water safety regulatory system.Through comparisons,the study found that Chinese marine water safety regulatory system has problems such as Legislative revision lags behind,negligence of public participation,“multiple regulation”,difficulties in coordination,loose sea water quality standards,lagging updates,and unreasonable punishment mechanisms for sea water pollution behavior.Then it proposes to improve Chinese marine water safety regulatory system.
