论道教与唐代法律思想的关系

On the Relationship Between Taoism and the Legal Thoughts of the Tang Dynasty

中国古代社会,在统治者法律思想中居于主导地位的是儒家法律思想,但是其他学说、思想对于法律思想也有不同程度的影响。在唐代,兴盛的道教实际影响着统治者的法律思想。道教对唐代法律思想的影响,表现为清静无为、身国共治、立法宽简等内容。同时,道教对于唐代君主和唐代官员的法律思想也有不同程度的影响。分析道教与唐代君主、唐代官员法律思想的关系,可以看出道教与唐代法律思想的关系十分密切,进而对于唐代立法、司法发挥作用。

In ancient Chinese society,Confucianism was dominant in the legal ideology of the rulers,but other theories and ideologies had different influences on legal thoughts.In the Tang Dynasty,the flourishing Taoism actually influenced the rulers’legal thoughts.The relationship between Taoism and the legal thoughts of Tang Dynasty’s emperors and officials in Tang Dynasty could be found easily.The relationship between Taoism and Tang Dynasty’s legal thought is very close,and it plays an important role in the legislation and judicature.
