经典作家劳工权益问题的系统探究——析《〈资本论〉劳工权益思想研究》

A Systematic Study on Labor Rights and Interests of Classic Writers——By Analyzing “On the Thought of Labor Rights of ’The Capital’”

我国法学界非常重视研究《资本论》中的法律思想,这些研究基本上遵循了两个基本思路,一是注重从法哲学视角阐发《资本论》对历史唯物主义法学观形成与发展的重要意义,另一个是关注《资本论》中比较具体的法律问题。第二种思路相对来说比较薄弱。《〈资本论〉劳工权益思想研究》一书,致力于经典著作中的现实关怀,通过运用劳工权益这一概念性工具,系统梳理了《资本论》中的法律思想,比较完整地呈现了马克思恩格斯的劳工权益思想,也是运用辩证唯物主义的典范。《权益》还应当进一步考虑到,"劳工""工人阶级""无产阶级""工人"等概念的辨析,深入探索经典作家劳工权益思想与当前总体状况的逻辑衔接。

The legal circle in China attaches great importance to the study on the legal thoughts in"The Capital".These studies basically follow two basic lines of thoughts:The first is to expound the significance of"The Capital"to the formation and development of historical materialism jurisprudence from the perspective of legal philosophy;Another is to focus on the more specific legal issues in"The Capital".The second approach is relatively weak.The Book"On the Thought of Labor Rights of‘The Capital’"dedicates to the realistic concern in classic works.By using the conceptual tool of labor rights,it systematic reviews of the legal thoughts in"The Capital",presents the labor rights thought of Marx and Engels in a relatively complete way,and is used as a model of dialectical materialism.This book should be given to the analysis to the concepts of"labor","working class","proletariat"and"worker",and thoroughly exploring to the logical link between the thought of labor rights and the current general situation of classical writers.
