行政法课程鉴定式案例解析教学方法论

摘要 德国“鉴定式案例解析法”作为一种被实践证实的理想法学教学方法,在民法学课程教学的研习中已形成固定的分析框架,它能够提升法科学生的法律适用能力以及法律职业资格考试的能力,被视作法科生的一门手艺和技术。行政法课程教学的鉴定式案例解析法,需要创造一定的条件,建立一套有别于民法的解析框架。行政法课程教学的案例解析法首先要审查行政行为有无法律授权基础,其次从行政行为的主体合法、程序正当、内容合法三个维度进行合法性鉴定式分析,最后审查行政行为是否符合理性。 German“appraisal case analysis method”,as an ideal teaching method of jurisprudence proved by practice,has formed a fixed analytical framework in the teaching and learning of civil law,which can improve the ability of law majors to apply the law and the ability of the legal professional qualification examination,being regarded as a craft and technology of law majors.The appraisal case analysis method of administrative law course teaching needs to create certain conditions and establish a set of analytic framework different from civil law.The case analysis method of administrative law course teaching should examine whether the administrative act has the basis of legal authorization,then analyze the legality from three aspects such as the lawful subject,proper procedure and lawful content,and finally,examine whether the administrative action is reasonable or not.
