摘要
政治秩序何以现代、如何建构是很多学者所思考和关心的问题。本文以霍布斯和马克思的国家理论为切入点,规范性地分析和论证了现代政治秩序的建构过程。通过比较分析霍布斯和马克思的国家理论,本文认为主权国家是现代政治秩序的主要实现途径,其背后体现的是现代性的主体思维;现代政治秩序是政治塑造秩序的过程,所以权力构成了现代政治社会的基础,而建构主权国家则是实现现代政治秩序的重要步骤,霍布斯和马克思分别选择了和平缔约和暴力革命的机制和方式来完成此种主权国家的建构,进而确立了现代世界的法权政治秩序。
Why the political order is modern and how it is constructed,is a question that many scholars have thought and concerned about.And regarding Hobbes and Marx on state theory as the basis,this paper normatively analyses and demonstrates the construction process of modern political order.Then by comparing Hobbes’state theory with Marx’s state theory,this paper holds that sovereign state is the main way to construct modern political order,which embodies the subjective thought of modernity;modern political order is the process that is politics shapes order,so that power constitutes the basis of political society and constructing sovereign state is the important step to reshape the modern political order.And Hobbes and Marx chose the different mechanism and way of peaceful contracting and violent revolution for finishing the construction of sovereign state,and finally established the political order of legal right in the modern world.
