2022年关于中国仲裁和争议解决的英文文献综述

本文选取并评析了31篇发表于2022年的与中国相关的仲裁及争议解决方面的英文文献。这些文献反映出国际上对中国仲裁和争议解决机制的核心关注点。通过对这些文献的分析,笔者发现国际上对中国仲裁和争议解决机制的关注主要聚焦于《中华人民共和国仲裁法(修订)(征求意见稿)》的讨论、争议解决中的适用法和证据问题、仲裁裁决的承认与执行问题、投资仲裁问题、中国与国际争议解决机制和仲裁与人工智能等方面。本文通过对上述文献的归纳和评述,试图展示英文文献在中国仲裁与争议解决的研究上的观点,帮助中文读者从另一视角了解相关问题在国际上的共识与争议,促进中外从业者和学术界的沟通。

This study conducts a comprehensive review of 31 English-language articles and manuscripts published in 2022 on topics of arbitration and dispute resolution in China.These articles reflect the primary concerns of the international community regarding China’s arbitration and dispute resolution mechanisms.Our review reveals the hot topics include the Proposed Amendments to the Chinese Arbitration Law in 2021;issues of applicable law in arbitration and dispute resolution;evidentiary issues in arbitration;recognition and enforcement of arbitration awards;investment arbitration;international dispute resolution mechanisms in China’s context;and artificial intelligence in the context of arbitration.This article endeavours to facilitate Chinese readers’comprehension on these issues and foster the communication between practitioners and academics both domestically and abroad by presenting the literature review of the manuscripts above.
