ISDS仲裁机制下安全例外条款管辖问题研究——以仲裁庭管辖权能扩张为背景

ISDS仲裁机制下安全例外条款的管辖呈现在矛盾之中。仲裁庭在内部驱动及外部条件加持下通过对IIA相应条款的解释扩张管辖边界,极易将安全例外纳入其中,而本身又尽量避免与之正面交锋,外界也有质疑的声音,如此状态下,为明确ISDS机制下安全例外条款的管辖问题,缔约方可以选择在IIA中明确表达态度,仲裁庭也应当在裁决中给出更充分的解释和更有信服力的说明。

The jurisdiction of security exceptions clause under ISDS arbitration mechanism is in contradiction.The arbitral tribunal,driven internally and supported by external conditions,expands the jurisdictional boundaries by interpreting the corresponding provisions of IIA.It is easy to include security exceptions.The arbitral tribunal has tried to avoid confronting it directly.There are skeptics,too.In this state,in order to clarify the jurisdiction of security exceptions clause under ISDS mechanism,Parties may choose to express their views explicitly in the IIA,The arbitral tribunal should also give fuller and more convincing explanations in its award.
