青少年和学校体育法治现代化的价值意蕴、问题审视及实现路径

The Value Implication,Problem Examination and Realization Path of the Modernization of the Rule of Law in Youth Sport and School Physical Education

走中国式现代化青少年体育发展道路需要加强青少年体育的法律保障。新《体育法》为青少年和学校体育发展提供了有力的法律支撑。运用文献资料法和逻辑分析法,针对青少年和学校体育发展中的问题从法律保障层面进行学理阐释,并结合青少年和学校体育发展的现实问题,围绕实施高标准、全方位法律保障的时代诉求;实现体育教学改革法治保障的必然要求;巩固体育强国建设根基的现实要求;强化体育法律体系协同性的内在要求4个方面阐释体育法修订的价值意蕴。研究认为,学校体育教学改革的法治保障问题、竞技后备人才培养的法治保障问题、中高考体育制度的法治保障问题、青少年体育健康促进的法治保障问题是当前青少年和学校体育法治现代化面临的现实问题,并进一步从优化学校体育教学改革、提升竞技后备人才培养、健全中高考体育制度、加强体育健康促进的法律保障方面提出促进青少年和学校体育发展的法律保障路径。

To follow the path of modernization of youth sport development in China,it is necessary to strengthen the legal protection of youth sport.The newly revised Law of the People’s Republic of China on Physical Culture and Sports provides powerful legal support for the development of youth sport and school physical education.Using research methods of literature review and logical analysis,this study provides a theoretical interpretation of the legal protection of youth sport and school physical education development,and takes into consideration the practical problems of youth sport and school physical education development to explain the value of the revision of the sports law from four aspects:the demand of the times for implementing high-standard and comprehensive legal protection,the inevitable requirement for the legal protection in realizing the reform of physical education,the realistic requirement for consolidating the foundation of building a sports power,and the inherent requirement for strengthening the synergy inside the sports legal system.The study believes that the issues of legal protection for school sport physical education reform,the legal protection for the cultivation of reserve talents for competition,the legal protection for the sports system of middle and high school entrance examinations,and the legal protection for the promotion of youth sport health are the real problems faced by the modernization of youth sport and school physical education law.Furthermore,the study concludes with a legal protection path to promote the development of youth sport and school physical education from the aspects of optimizing the legal protection of school physical education reform,enhancing the legal protection of reserve talents for competition,improving the legal protection of the sports system of middle and high school entrance examinations,and strengthening the legal protection of sports health promotion.
