我国体育仲裁机构的设立与运行机制

The Establishment and Operation Mechanism of Sports Arbitration Agency in China

新修订的《体育法》增设“体育仲裁章”,明确建立我国独立的体育仲裁制度。国务院体育行政部门依法设立中国体育仲裁委员会,制定《中国体育仲裁委员会组织规则》《体育仲裁规则》,完善相关配套机制,推进我国体育仲裁机构的设立和运行。我国体育仲裁机构的设立和规则制定充分体现了体育仲裁的独立性、专业性特点,既坚持中国特色,又与国际接轨,并以系统性和灵活性相结合的方式,形成“规则+章程+工作办法”的规则体系,建成公平高效的仲裁运行机制。但在制定规则以及机构运行中,始终会面临着仲裁范围厘定、与其他体育纠纷解决机制衔接以及体育仲裁特别程序运行等问题。为此,需秉持“能动解纷”的思路,坚持独立、协同的理念,立足中国体育法治实践需求,解决体育仲裁中的具体问题,完善体育仲裁制度,推动实现我国体育纠纷解决体系和能力现代化。

The newly revised Law of the People’s Republic of China on Physical Culture and Sports added a“Sports Arbitration Chapter”,making clear the establishment of an independent sports arbitration system in China.The administrative department of sports under the State Council established the China Commission of Arbitration for Sport in accordance with the law,formulated the Organizational Regulations of the China Commission of Arbitration for Sport and the Regulations of Arbitration for Sport,improved relevant supporting mechanisms,and promoted the establishment and operation of China’s sport arbitration agency.The establishment of China’s arbitration agency and the formulation of regulations fully reflect the independent and professional characteristics of arbitration for sport,adhering to Chinese characteristics while staying in line with international standards.In a systematic and flexible manner,a rule system of“rules+statutes+working methods”is formed,and a fair and efficient arbitration operation mechanism is built.In rule-making and agency operation,there will always be problems in defining the scope of arbitration,connecting other dispute resolution mechanisms for sport and operating special procedures of arbitration for sport.In this regard,it is necessary to uphold the idea of“dynamic dispute resolution”,adhere to the concept of independence and coordination,base on the needs in carrying out the Chinese sports rule of law,solve specific problems in arbitration for sport,improve the arbitration system for sport,and promote the modernization of dispute resolution system and capacity for sport in China.
