中国职业足球联盟建立的原则、基础与思路

The Principle,Basis and Thoughts on Constructing the Chinese Professional Football League

2014年10月,国务院《关于加快发展体育产业促进体育消费的若干意见》(国发〔2014〕46号)出台,明确提出"发展职业联盟,逐步提高职业体育的成熟度和规范化水平"。在足球领域,建立中国职业足球联盟是加快中国职业足球改革步伐、促进中国足球发展的重要手段。但我国的足球职业化尚不成熟,因此,建立中国职业足球联盟需要学习欧洲经验,即认真贯彻体育自治原则,保证联盟高度的自治权。同时,应将法人治理结构作为联盟成立的法律基础,实现相关利益主体之间的权力、责任和利益的相互制衡。最后,明确建设思路,即政府、足协与俱乐部通力合作,共同推动中国职业足球联盟建设。

The document of the"Guidance of Accelerating the Development of Sports Industry and Promoting the Sports consumption"(No.46)is issued by the State Council in October,2014,which explicitly proposes construction of the Chinese professional football league and gradual rise of maturity and standardization of professional sports.As for football,the establishment of the Chinese professional football league is an important way to speed up Chinese professional soccer reform and promote the development of Chinese football.But football professionalization in China is far from mature.We can learn from the European experience in the establishment of China Professional Football League,that is,to implement the principle of sports autonomy and ensure the league’s high degree of autonomy.At the same time,we can take the corporate governance structure as the legal basis for the establishment of the alliance,and realize the mutual checks and balances of power,responsibility and interests among the relevant stakeholders.Finally,we should make clear the construction idea,that is,the government,the football association and the club should work together to promote the construction of China professional football league.
