我国行政法典的法律规范体系可以从四个方面予以定位:其一,“一般行政法律规范”还是“一般行政法律规范加部门行政法律规范”?行政法典宜选择仅对一般行政法律规范进行法典化,编纂行政基本法典。其二,“法治政府的法律规范体系”还是“行政权力的法律规范体系”?行政基本法典宜选择具备法典体系性的“行政权力的法律规范体系”定位。其三,“客观行政法律规范体系为主”还是“主观行政法律规范体系为主”?行政基本法典宜选择以确立和保障公民、法人和其他组织权利体系为中心内容的“主观行政法律规范体系为主”定位。其四,“传统行政法律规范为主”还是“大数据时代的行政基本法典”?我国行政基本法典宜全面回应数字法治政府建设的立法需求,定位于编纂数字时代的行政基本法典。

The legal norm system of the administrative code can be positioned from four different perspectives.First,should it consist of"general administrative law norms"or"general administrative law norms plus departmental administrative law norms"?The administrative code should only include the general administrative legal norms and codify the basic administrative code.Second,should it be considered as the"the legal norm system of the rule of law government"or"the legal norm system of administrative power"?The basic administrative code should adopt the position of"legal norm system of administrative power,"which embodies the characteristics of a code system.Third,should it be an"objective administrative law standard system"or"a subjective administrative law standard system"?The basic administrative code should adopt the position of“subjective administrative law standard system,”with the establishment and protection of civil rights system as its central focus.Lastly,should it consist of"traditional administrative legal norms"or be tailored to"the basic administrative code in the era of big data"?The basic administrative code should fully address the legislative requirements for constructing a digital rule of law government and aim at compiling the basic administrative code for the digital era.
