我国企业合规的刑事诉讼激励

Criminal Procedure Incentives for Corporation Compliance in China

目前企业合规已经成为一种世界趋势,是企业走向世界的通行证。企业合规不仅有利于我国企业走向世界,还有利于企业承担社会责任,解决新时代我国社会的主要矛盾。我国的强制性措施在激励企业合规方面具有天然的本土优势。不管在国内还是国外,程序分流都会对企业合规产生激励作用。有效的合规计划是刑事诉讼激励发挥作用的前提。我国刑事诉讼激励企业合规的实体法压力不足,应当加大部分罚金刑力度、完善刑罚种类,为企业合规提供适当的压力。在企业合规的过程中要学习美国等先行国家的经验,同时,对于美国等先行国家出现的问题要尽早避免。

Now corporation compliance has become a world trend and a passport for corporations to go to the world arena.Corporate compliance is not only beneficial for the Chinese corporations to go to the world arena,but also beneficial for corporations to undertake social responsibility to solve the main contradictions of our society in the new era.China’s mandatory measures have a natural local advantage in stimulating corporation compliance.Whether in China or abroad,procedural diversion such as NPA and DPA will motivate corporation compliance.An effective compliance plan is a prerequisite for criminal procedure incentives to work.The substantive law pressure for criminal procedure in China to encourage corporation compliance is insufficient.It should impose part of the fine penalty,improve the types of penalties and provide appropriate pressure for corporation compliance.In the process of corporation compliance,we should learn from the experience of leading countries such as the United States,at the same time,avoid problems arising from leading countries such as the United States as soon as possible.
