乡村振兴地方立法的质量是乡村振兴战略高效实施的关键,完善乡村振兴地方立法有助于提升乡村振兴立法科学化与体系化、强化乡村振兴战略的法治保障。基于法的要素、地方位阶和促进特质视角,全面审视乡村振兴地方立法文本,发现其间存在重复与雷同现象凸显、创制性与协调性不足、规范较为原则且缺少具体可行的激励措施等问题。为此,应完善评估制度以促进乡村振兴地方立法文本精练化,重视因地制宜以增强乡村振兴地方立法内容特色化,细化规范内容以助推五大领域有效衔接与政策落实,增加激励措施以强化地方立法促进特质及实效发挥。

The quality of local legislation on rural revitalization is the key to the efficient implementation of the rural revitalization strategy.Improving local legislation on rural revitalization is conductive to promoting scientific and systematic legislation on rural revitalization and strengthening the guarantee of the rule of law for the rural revitalization strategy.Based on the perspective of the elements of law,local status and promotion characteristics,a comprehensive review of local legislation on rural revitalization reveals that there are problems such as repetition and similarity,insufficient creativity and coordination,and the lack of incentives due to the principle of regulation.In this regard,the evaluation system should be improved to promote the refinement of local legislation on rural revitalization,and attention should be paid to local conditions to enhance the characteristics of local legislation on rural revitalization,the content of regulations should be refined to facilitate the effective connection and policy implementation of the five major areas,and increase incentives to strengthen the characteristics and effectiveness of promoting rural revitalization.
