建立在个人信息搜集、处理之上的科技新浪潮给我们带来新的发展机遇,也引起了包括法学界在内的普遍关注和讨论。然而,这种科技新时代却将人类置于前所未有的新危险和危机之中。权利是人们对现实和可能存在的侵害、危险的保障诉求方式。在这种科技新时代下,对个人信息的保护仅仅从民法、行政法或刑法层面作为一种权利进行讨论和研究是远远不够的。个人信息权应当被视为一种新兴(型)人权,以使我们更深刻认识到科技新时代可能带给我们的难以预料的危险和风险。

The new wave of science and technology based on personal information collection and processing has brought us new development opportunities,which has also aroused universal concern and discussion,including the legal field.However,this new era of science and technology has put mankind in unprecedented new danger and crisis.Rights are people’s way of claiming protection against real and possible infringement and danger.In this new era of science and technology,it is not enough to discuss and study the protection of personal information only from the level of civil law,administrative law or criminal law as a right.The right of personal information should be regarded as emerging type of human right to make us more aware of the unpredictable risks and risks that the new era of science and technology may bring us.
