整体政府改革下出现的新型行政权主体与行政职权再配置活动难以符合职权法定原则所提出的权力行使主体法定和权力行使范围法定两大子原则的要求,职权法定原则与整体政府改革直接发生冲突。冲突的成因是宪法意义的行政主体与行政法意义的行政主体适用情境错置所造成的职权法定原则变异。四层次行政主体说将权力行使主体法定原则的适用范围限制在政府层面,通过完善行政组织权理论,将权力行使范围法定原则转化为行政授权合法说,职权法定原则得以更新,整体政府改革进程中出现的一系列问题从理论上可以得到化解。
