论碳中和背景下我国用能权交易市场规则之完善

Research on the Perfection of China’s Energy-Consuming Right Exchange Rules under the Background of Carbon Neutrality

我国用能权交易制度目前正处于试点实践阶段,尽管用能权交易市场规则体系已经初步形成,但当前该规则体系存在立法层次偏低、市场运行规则粗糙、市场监管机制尚未理顺等问题。基于提升能效和实现碳中和目标的要求,用能权交易市场规则应当借鉴欧美白色证书交易实践的经验教训加以完善。究其路径而言,推进用能权交易法制化应当成为完善用能权交易市场规则的核心思路,同时应分别以打造开放多元的交易市场和构建合作型双支柱监管体系为目标,完善具体的市场运行规则和市场监管规则。

China’s energy-consuming right exchange system is currently in the pilot practice stage.Although the market rule system of energy-consuming right exchange has been initially formed,there are some problems such as low legislative level,rough market operation rules,and market supervision mechanisms that have not been straightened out.Based on the requirements of improving energy efficiency and achieving the goal of carbon neutralization,the energy-consuming right exchange market rules should learn from the experience and lessons of the white certificate trading practice.As far as the path is concerned,promoting the legalization of energy-consuming right exchange should become the core idea of improving the rules of energy-consuming right exchange market.At the same time,we should improve the specific market operation rules and market supervision rules with the goal of building an open and diversified exchange market and building a cooperative double pillar supervision system.
