摘要
《民法典》为农房居住权提供了广阔且可行的制度空间,但在具体制度设计层面,如何创设农房居住权,创设何种类型的农房居住权,其内在法权如何建构,如何与乡村振兴战略实现有效衔接和制度反馈,显然属于一个关联性、系统性工程。立足公平、自由、效益三大价值维度,在制度上应根据不同现实需求,将农房居住权区分为保障型、康养型及投资型三种类别并对其内在法权进行不同设计,力求以农房居住权为杠杆,撬动乡村沉睡的巨量资产,实现乡村不动产的有限市场化,增进农户收益,推动城乡和谐共荣。
The Civil Code provides a broad and feasible institutional space for the right to housing in rural areas.However,at the level of specific institutional design,how to create rural housing residential rights,what types of rural housing residential rights to create,how to construct their interal legal rights,and how to effectively connect with the rural revitalization strategy and provide institutional feedback are clearly related and systematic projects.Based on the three value dimensions of faimess,freedom and efficiency,it is advocated to classify the right to housing in rural areas into three categories:guarantee type,health care type and investment type according to different practical needs,and to design different internal legal rights.The aim is to leverage the right to housing in rural areas,leverage the huge assets that are dormant in rural areas,achieve limited marketization of rural real estate,enhance the income of farmers,and promote harmonious coexistence between urban and rural areas.
