论流域协调机制——以《黄河保护法》(草案)第四条为考察对象 被引量:5

On the River Basin Coordination Mechanism: With Focus on the Article 4 of the Draft Legislation on Yellow River Protection

摘要 为响应黄河流域生态保护和高质量发展的政策要求,从整体上提高流域治理效率,基于流域的整体性关联性和空间性特征,《黄河保护法》(草案)第四条建立了国家黄河流域协调机制,并对其基本功能和协调事项作出了安排。就整体而言,流域协调机制的基本功能包括统筹、协调和督促检查三大方面,在协调事项上应该以“重大”为前提扩大其协调范围。《黄河保护法》(草案)只对流域协调机制作了框架性规定,有必要对其实现进路予以细化与延展。具体来说,可以从宏观决策的联合议事、具体事项的日常会商与应急会商、决策执行的联动协作以及信息通报与信息共享四个方面共同推进流域协调机制的实施。 In order to respond to the policy requirements of ecological protection and high-quality development of the Yellow River Basin,and to improve the unified governance efficiency,based on the integrity,relevance and spatial characteristics of the basin,the Article 4 of the"Draft Legislation on Yellow River Protection"established the National Yellow River Basin Coordination Mechanism and made arrangements for its basic functions and coordination matters.On the whole,the basic functions of the River Basin Cooraination Mechanism include three aspects:comprehensive arrangcment,coordination,and supervision and inspection.In terms of coordination matters,the scope of coordination should be expanded on the premise of“significant”.The Draft Legislation on Yellow River Protection only provides framework regulations for the river basin coordination mechanism,and it is necessary to refine its realization path.Specifically,from the four aspects of joint discussion of macro decision-making,daily and emergency consultations on specific matters,collaborative implementation of decision-makings,and information notification and information sharing,jointly promote the implementation of the river basin coordination mechanism.
