取水权纳入不动产登记的正当性及路径

摘要 水资源确权登记是统一确权登记的重要内容,具体包括水资源所有权和取水权确权登记,水资源所有权已经纳入自然资源统一确权登记。取水权作为法定的用益物权,在客体、取得方式和权能上具有特殊性。由于水资源统一确权登记是中央的明确要求,不动产登记做了一定制度准备,取水许可难以担负确权登记的功能,相关国家和地区有成熟的经验,因而取水权应纳入不动产登记范畴。在实现路径上,应确立取水权的不动产登记能力和效力,明确取水许可与不动产登记的衔接方式,制定取水权登记的操作细则。 The water resources right confirmation and registration is an important part of the unified rights confirmation and registration system of natural resources,which includes the registration of the property right of water resources and the water intake right.The property right has been included in the unified confirmation and registration of natural resources.As a legal usufructuary right,the water intake right has its particularities in the object,acquisition mode and power.The real estate registration has made a certain system preparation.Because water resources right registration is the explicit requirement of the Central Government.It’s difficult for the water intake license to assume the function of property right registration.In addition,some countries and regions have mature experience in this field.So the water intake right should be incorporated into the real estate registration.In the realization path,we should establish the real estate registration capacity and effect of the water intake right,make clear the connection way between the water intake license and real estate registration,and formulate the detailed rules for implementation of water intake right registration.
