土地资源在中国经营性高速公路收益补偿中的利用方式

Land Resource Utilization Mode of China’s Commercial Expressway Profit Compensation

为更好盘活利用土地资源补偿经营性高速公路经营主体因政策性因素发生的收益减损,保障其合法权益,首先分析了经营性高速公路收益补偿面临的问题、明晰了土地资源参与补偿的内涵,然后按照土地资源在补偿中扮演角色和实现路径,将利用土地资源进行收益补偿的方式分为两大类:充当中间媒介的提取土地收益方式和作为交易主体的土地使用权变更方式,综合考虑政府与市场的交互机制,分别研究了各种补偿方式的实施路径,并提出了对土地形式补偿的管理思路。结果表明,经营性高速收益补偿中利用土地资源需要遵循四项原则,以期为当前及未来经营性高速公路收益补偿政策措施和如何更好、更灵活运作土地资源助力其他交通基础设施的建设经营活动提供较为系统全面的依据。

To better revitalize the use of land resources to compensate for the profit loss caused by policy factors for operating subjects of commercial expressway,and to protect the legitimate rights and interests,firstly the problems facing commercial expressway profit compensation were analyzed.The connotation of land resources participating in compensation was clarified.Then,according to the role and realization path of land resources in compensation,the ways of using land resources for revenue compensation were divided into 2 categories,i.e.,extracting land revenue as the intermediate medium and changing land use right as the trading subject.By comprehensively considering the interaction mechanism between government and market,the implementation paths of various compensation methods were studied.The management ideas for land-form compensation were proposed.The result indicates that the land resources utilization in commercial expressway profit compensation needs to follow 4 principles.It is expected to provide the relatively systematic and comprehensive basis for the current and future compensation policies and measures for commercial expressway revenue,as well as for how to better and more flexibly leverage land resources to support the construction and operation of other transportation infrastructures.
