CPTPP's Organizational Pattern and Operation Model——The Decline of Formal Organization and the Uprising of Global Administrative Law

《全面与进步跨太平洋伙伴关系协定》是亚太区域内高标准的区域自由贸易协定。世界贸易组织规则最惠国待遇原则的例外规定条款为其提供了合法性和正当性基础。CPTPP在组织法上的组织形态属于国际组织法框架下的多边条约执行机构。成员方并未选择以构建国际组织的方式来设计CPTPP的合作模式,从而克服了这一传统模式运行中遇到的阻力。通过委员会制来进行领导是CPTPP组织结构的一大特点。同时因监管一致性、透明度和反腐败等规则的存在,CPTPP更偏向于全球行政法的实施模式。CPTPP的组织运行在整体上呈现出“解构组织”的趋势。各成员方在此合作框架下更注重规则行政与执行的效率,刻意淡化立法和司法的功能。在实现真正的成员驱动的基础上,CPTPP的组织形态和运行模式能够产生合力推进区域贸易与投资规则的执行。中国在申请加入的过程中,应首先需要对CPTPP组织机构及其运行形成整体性认识。

The Comprehensive and Progressive Trans-Pacific Partnership(CPTPP)is a high-standard regional free trade agreement within the Asia-Pacific region.The exception clause to the most-favored-nation principle of the World Trade Organization rules provides the legality and legitimacy basis for the CPTPP.Moreover,the CPTPP organizes itself constitutionally as a multilateral treaty enforcement agency under the framework of international institutional law.The members did not choose to design the CPTPP's cooperation model in the form of an international organization,thus overcoming the resistance encountered in the operation of traditional international organizations.Leadership through the committee system is a key feature of the CPTPP's organizational structure.The CPTPP's organizational operation shows an overall trend of deconstructive organization due to the existence of rules of regulatory consistency,transparency and anti-corruption.The members focus more on the efficiency of rule administration and executive under this cooperative framework,deliberately downplaying the legislative and judicial functions.On the basis of achieving true member-driven,the organizational form and operation mode of CPTPP can generate synergy to promote the implementation of regional trade and investment rules.In the process of applying for membership,China should first need to develop a holistic understanding of the CPTPP organizational structure and its operation.
