郑斌教授国际法、航空航天法主要学术贡献评述

Professor Bin Cheng’s Major Academic Contributions to International Law and Aerospace Law

郑斌教授专注于国际法学、航空航天法学研究八十余年,为国际法、航空航天法的发展作出了杰出贡献。郑斌教授的国际法、航空航天法思想是一个内容丰富、逻辑严整、极富前瞻性和创造性的理论系统,在国内外颇具影响力。在国际法学领域,他明确了国际法院所适用的一般法律原则的含义及法律地位,消除了"基本原则"适用的模糊性;在国际航空法学领域,他总结了国际航空运输的组织及法律框架。此外,郑斌教授对速成国际习惯法、双梯度责任和限额定期复审机制的阐释,及其空天一体化理论为后续研究提供了重要的思想渊源。教授在国际法学、国际航空法学以及外层空间法学的重要学说及观点,既有理论意义,又有实践价值。学习其理论思想不仅有利于我国国际法学研究,而且有助于我国加快制定与完善航空航天法律及政策,推进航空航天治理与航空航天强国建设。

Professor Bin Cheng had focused on the research of international law and aerospace law for more than 80 years,and had made the outstanding contributions to the progressive development of them.His thoughts on international law,air law and space law are a theoretical system with rich content,strict logic,foresight and creativity,and have a great influence in the world.In the field of international law,he clarified the meanings and legal status of general principles of law as applied by international courts,and eliminated the ambiguity in the application of"general principles".In the field of international air law,he summarized the framework of International Civil Aviation Organization and legal regime of air transport.Furthermore,his presentations on"instant international customary law""two-tied liability system"and"review of the limits of liability",as well as the theory of the space-aeronautics incorporation,provide significant ideological sources for the following fellows.His doctrines and opinions on international law,air law and space law have both theoretical and practical value.Not only can they contribute to our theoretical research on international law,but also can help China make and perfect regulations and policies about air and space law rapidly.Besides,they also can promote China’s aerospace governance and help to build a powerful aeronautics and astronautics country.
