《黄河保护法》实施背景下流域生态环境规制思路与完善对策——基于法律政策文本量化分析

Quantitative analysis on the eco-environmenal regulatory system for Yellow River Basin and improvement options under the implementation of Yellow River Protection Law

以1949年以来我国黄河流域生态治理的法律政策文本为研究对象,运用政策文本量化分析方法,对黄河流域生态环境治理主体、规制强度、规制工具的选择等方面分析得出:我国黄河流域生态环境治理主体统筹、职能部门协调、规制工具选用偏好等方面均呈现出协同效果不足的困境。《黄河保护法》的颁布实施对流域立法和管理体制的完善具有重要的引领功能。应尽快理顺流域规制思路,完善规制路径,推动我国黄河流域生态保护和高质量发展,保障黄河安澜。

Taking legal and policy texts of ecological governance for the Yellow River Basin since 1949 as the research object,based on a quantitative analysis of policy tools,the subjects of ecological environmental governance,the intensity of regulation and the choice of regulation tools of the Yellow River Basin were analyzed.Dilemma was recognized in all these areas including arrangements of governance subjects,coordination of functional departments,and the choice of regulatory tools.The promulgation and implementation of the Yellow River Protection Law is of an important guider for the improvement of legislation and management systems for the Yellow River Basin.It is necessary to streamline regulatory ideas and improve regulatory paths as soon as possible,to promote the ecological protection and high-quality development of the Yellow River Basin and ensure the peace of the Yellow River.
