摘要
《政府采购法》与《招标投标法》采取了分散立法模式,一定程度上割裂了政府采购行为,加之行政主导立法模式的干预及立法条件的制约,造成了两部法律之间的差异和重叠现象,政府采购法制处于分散不统一的状态。本文立足于现有法律法规,重点从采购模式、采购方式、监督体制等方面论述两部法律之间的差异、重叠及其产生的法律适用冲突问题。研究结果表明,两部法律的融合路径有合并或并存两种方式,“两法”合并已具备理论基础和条件,但目前尚不具备实现的现实基础。
Government procurement law and bidding law have adopted a decentralized legislative model,which separates the government procurement behavior.In addition,the intervention of the administrative led legislative model and the restriction of legislative conditions have resulted in the difference and overlap between the two laws,and the government procurement legal system is in a decentralized and non-uniform state.Based on the existing laws and regulations,this paper discusses the differences,overlaps and conflicts between the two laws from the aspects of procurement mode,procurement method and supervision mechanism.The results show that the integration path of the two laws is the combination of two laws or the coexistence of two laws.The combination of two laws has the theoretical basis and conditions,but now,it does not have the realistic basis to realize the combination.
