人工智能下侦查主体性的思考

On the Subjectivity of Investigation from the Perspective of Artificial Intelligence

人工智能推动世界的发展,在司法领域人工智能涉及到公检法三机关。公安机关往往作为司法活动的开始,人工智能的运用在后续活动中具有关键性作用。人工智能辅助侦查机关提升侦查效率强化侦查意识。侦查主体是侦查活动的实施者,技术能否满足侦查主体的需要至关重要。但人工智能本身的数据与算法问题和侦查主体在技术影响下表现出的意识依赖化、僵硬化和极端化等问题都会对人工智能的使用产生影响,这就需要侦查主体明确自我意识,强化学习能力、同时在制度上实现政策的更替以及在面对技术难题时灵活应对发挥主观能动性。

Artificial intelligence promotes the development of the world.In the field of justice,artificial intelligence involves the three organs of the public security,the procuracy and the court.As the beginning of judicial activities,the use of artificial intelligence plays a key role in the following activities.Artificial intelligence assists the investigation organs to strengthen investigation consciousness and improve investigation efficiency.The subject of investigation is the executor of investigation activities.It is critical whether technology can meet the needs of the subject of investigation.The use of AI will be impacted by the problems of AI data and algorithm,as well as the consciousness dependence,rigidity and extremeness of the investigation subject under the influence of technology.Therefore,investigation subject should clarify self-consciousness,strengthen learning ability,realize policy replacement in system,and tackle the technical problems flexibly and initiatively.
