政务数据开放共享中的个人信息保护研究

Research on the Personal Information Protection Based on the Perspective of Opening and Sharing Government Data

政务数据的开放共享增加了个人信息保护的风险和难度。个人信息保护方面存在着个人信息的收集使用机制亟需建立和健全、数据开放与个人信息保护的关系需要协调和平衡、个人信息保护技术有待创新和完善、法律法规及监管机制仍需强化和落实等困境和挑战。本文在对其他国家经验进行借鉴与反思的基础上,提出了建立完善的个人信息保护机制、平衡政务数据的开放共享与个人信息保护之间的关系、提高技术水平和管理能力、增强法律法规的执行效率和执行力度等对策与建议,以期为我国政务数据开放共享背景下的个人信息保护提供一定的研究思路。

Opening and sharing government data will increase the risk and difficulty of protecting personal information.The system of Collecting and using personal information should be perfected and improved.The relationship between personal information protection and opening big data should be coordinated.The technology used,of protecting personal information,should be further improved.Laws,regulations and supervision mechanisms still need to be implemented and strengthened.Based on the experience of other countries,this paper put forward some countermeasures and suggestions with a view to provide some research ideas of personal information protection under the background of opening and sharing government data.
