论欧洲购房投资移民法律制度与腐败犯罪的联系及防治

购房投资移民,是指移民申请者通过购买一定价值的不动产获得移民目的国的居留权,永久居留权或是护照的投资移民政策.欧洲地区通过购买房产获得居留权的政策源于希腊,随之不少欧洲国家纷纷效仿.由于欧洲地区较发达的经济状况及完善的社会保障体系,加之购买房产的投资移民在程序操作上相对便捷且监管标准又比较宽松,因此在短时间内吸引了全球不少投资移民者的注意.与之相伴的是,不少违法犯罪人员,特别是贪腐人员试图且已经利用购买房产获得居留权或护照的政策变换身份的案件频发.针对贪腐人员利用投资移民政策漏洞外逃并转移非法资产的案件,分析他国投资移民法律制度及与其他法律监管制度的衔接,提出完善我国通过购买房产向外投资移民的监管建议,正是本文关注的重点.

This kind of investment immigration refers to those immigrations by buying certain amount price of real estate in the destine country to obtain the residence,permanent residence or passport.This type of policy of investment immigration in Europe started from Greece,then many other European countries carried out the similar policy.Due to have the developed economic situation and perfect social benefits,as well as the fast process and the loose criteria of supervision in the policy of investment immigration,lots of potential investment immigrations have great interested in it.At the same time,many suspects,especially those corruptive officers want and already took advantage of the loopholes of the policy to escape and transfer the illegal assets.Therefore,this paper will focus on these cases,analysis the foreign legal system of investment immigration and the connection with the completely legal system,also provides the suggestions for improve the supervision on outward investment immigrations of China.
