网络版权刑法保护既是法律对网络传播技术发展挑战的应对,也是执行我国知识产权强保护战略,提升以版权为基本内容的文化软实力的重要法律手段.在大数据、云计算、智能化时代,如何用刑法保护网络版权,必须深入研究探索.为此,有必要全面了解网络版权刑法保护的变化历程,揭示其演进的路径及内生逻辑与层次,探寻发展趋势,以便预测未来.网络版权的刑法保护从无到有,从粗到细,从弱到强,与时俱进,层层推进,涉及基本法律、行政法规和司法解释三个层级的法律规范.2001年修订《著作权法》,开启网络版权的刑法保护,与《刑法》衔接,共同从基本法律的层面为网络版权提供刑法保护.2006年制定的《条例》细化了侵犯网络版权的犯罪行为,从行政法规的层面充实丰富了基本法律的内涵.三个司法解释与司法文件从司法解释的层面对基本法律以及行政法规进行强力解释,便于司法操作,落实和深化了网络版权的刑法保护.将来,网络版权的刑法保护还应进一步加强.

The Criminal law protection of network copyright is not only a legal response to the challenge of the development of network communication technology,but also an important legal means to implement the strategy of strong protection of intellectual property rights and enhance the cultural soft power with copyright as its basic content.How to protect network copyright with criminal law must be deeply studied and explored in the era of big data,cloud computing and intellectualization.Therefore,it is necessary to fully understand the changing course of criminal law protection of network copyright,reveal its evolutionary path and endogenous logic and level,and explore the development trend in order to predict the future.The criminal law protection of network copyright has developed from scratch,from coarse to fine,from weak to strong,advancing with the times and advancing at different levels,involving three levels of legal norms:basic laws,administrative regulations and judicial interpretation.In 2001,the Copyright Law was amended to open up the criminal law protection of network copyright and link up with the Criminal Law to provide criminal law protection for network copyright from the basic legal level.In 2006,the regulations have refined the crime of infringing network copyright and enriched the connotation of the basic law from the level of administrative regulations.Three judicial interpretations and one judicial document have made strong interpretations of the Basic Law and Administrative Regulations from the level of judicial interpretation,which is conducive to the judicial operation and the implementation and deepening of the criminal law protection of network copyright.In the future,the criminal law protection of network copyright should be further strengthened.
