当代中国的法治建设始终坚持的是马克思主义政治观,重视和倚赖国家权威,采取理性构建的态度.在法律创制、法律执行、法律适用和法律遵守等法律运行的各环节,国家都是首要推动力,发挥着无可取代的关键作用.依法治国实践中的国家主导表现为由执政党主导法治进程,青睐规制中心主义的立场和建构主义的方法论.党的十九大将全面依法治国上升为坚持和发展中国特色社会主义的全局性方略,法治国家、法治政府、法治社会的一体建设需要在继续坚持国家主导之下.

Choosing the rule of law is the most important institutional achievements in the past 70 years.Autonomous construction approach is the realistic choice of the rule of law in China.Guided by Marxism,promoted by state shaped this special approach,and the ruling Party took as the ultimate authority.Before the 18th National Congress of CPC,our construction of the rule of law paid more attention to and relied on state power,and preferred rule-centered position and constructivist methodology.Law-based governance is an essential requirement and important guarantee for socialism with Chinese characteristics at the 19th National Congress.The rule of law approach in the new era will continue to be improved by pluralistic coordination of the state,society and individuals.
