中药创新品种与改良品种的保护机制研究——基于欧美药品非专利保护机制的启示

除专利制度外,欧美推行了系列非专利制度,将改良药品纳入了知识产权保护中.对于渐进发展特性十分突出的中药而言,改良与创新同等重要,中药改良产品与创新产品都值得知识产权保护.中药品种保护制度具有发展为中药知识产权特有保护制度的潜力,在探讨其知识产权保护机制时,应对中药创新品种予以"强"保护以达成"激励"效果,对中药改良品种予以"弱"保护以达成"促进"效果.

In addition to the patent system,non-patent protection mechanisms for medicines has been implemented in Europe and America,improved drugs then become the object of intellectual property protection.For traditional Chinese medicine(TCM),which has a very incremental nature,improvement and innovation are equally important.Both of the improved products and innovative products of TCM deserve intellectual property protection.The protection system for varieties of TCM has the potential to develop into a sui generis system for TCM knowledge.When discussing its protetion mechanism of intellectual property rights,the innovative varieties of TCM should be“strongly”protected to achieve“incentive”effect,and the improved varieties of TCM should be“weakly”protected to achieve“promotion”effect.
