Functional Spillover and Selection of Production and Broadcasting:The Knowledge Mechanism of TV Mediation’s Operation

“电视调解”节目曾经火爆于卫星电视台,而当下只能兴办于地方有线电视台,对于此种有趣现象尚缺乏足够理论解释.由于“电视调解”是人民调解制度实施的一种形式,因此,“电视调解”节目在高收视率的商业目标下要实现人民调解制度功能,即“预防化解矛盾纠纷、普法教育”.根据“电视调解”节目的“电视节目”和“案件调解”双重属性,本文构造出“‘电视调解’运行的分析框架”,按“受众特性”“节目语言(国语/方言)”“议题冲突性”“调解的依据”和“调解的结果”五个指标把“电视调解”节目分为“情感沟通型”“纠纷调解型”“法律判断型”三种类型.最后,通过对现存于网络的15个“电视调解”节目、8119期的视频进行上述八个指标的编码、数据输入和初步统计后,笔者发现:由节目语言、议题冲突性和调解的依据所体现出来的国家性或地方性知识影响到“电视调解”节目制度功能的溢出,也最终决定地方电视台选择制播何种类型的“电视调解”节目,以及选择使用卫星还是地方有线电视播放“电视调解”节目.

The TV mediation program was once popular on satellite TV stations,whereas nowadays it can only be operated at local cable TV stations.There is still a lack of sufficient theoretical explanation for this interesting phenomenon.As a form of implementation of people’S mediation system.TV mediation must realize two functions of people’S mediation system through its programs with the high-visibility business objectives,which are“preventing and resolving contradictions and disputes”and“popularizing law education”.According tO the dual attributes of“television program’’and“case mediation”in the“TV mediation”program.this paper constructs an analytical framework for the operation of television mediation.TV mediation programs can be divided into three types as“emotional communication”,“dispute resolution”,and“legal judgment”,with five indicators which are audience characteristics,program language(Mandarin/Dialect),degree of topics’conflicts,basis of mediation,and results of mediation.Finally,after encoding,data input and preliminary statistics of the above eight indicators for 15 TV mediation programs and 8,119 videos existed in the network,this article finds that:It is the language of programs,the degree of topics’conflicts and the basis of mediation that embody the national or local knowledge,which affect the spillover of the functions of TV mediation program system.It also ultimately determine the types of programs that local TV stations choose tO produce,and the use of satellite or local cable TV to play the mediation program.
