民法典物权编应规定混合共同担保追偿权 被引量:28

摘要 混合共同担保人之间的追偿权在权利属性上属于法定追偿权而非代位追偿权,连带责任理论、法定债权移转等不能替代混合共同担保中的追偿权,由于混合共同担保具有实现公平价值、分散风险、鼓励担保、防止道德风险等功能,因此,民法典物权编应对此加以明确肯定.在追偿权的具体行使上,追偿份额的确立原则上应予以平摊,特定情况下需按比例确定,且混合共同担保人之间的追偿权份额的确立只能行使一次,以避免发生循环追偿现象. Abstract:The right of recourse between mixed co-guarantors belongs to statutory recourse right rather than subrogation right in the attribute of rights.The theory of joint liability,the transfer of legal claims,etc.cannot replace the recourse right in the mixed co-guarantee,because the mixed co-guarantee has to achieve fairness,diversify risks,encourage guarantees,prevent moral hazard and other functions,therefore,Property Law chapter in the Civil Code should clearly affirm it.In the specific exercise of the right of recourse,the establishment of the recourse share should be equalized in principle.In certain cases,it must be determined proportionally,and the recourse right between the mixed co-guarantors can only be exercised once to avoid the circular recovery.
