平行进口(parallel imports)是一个久远的话题,但目前世界各国对商标权的平行进口并没有统一的立场。随着中国外贸政策的微调及中国加入经济全球化的程度加深,在我国立法并未完善的情况下,国内的进口商如何最大程度地保护自身的利益,避免商标平行进口纠纷将是一个不可避免的课题。该文主要分析世界主要发达国家及地区的平行进口立法实践及相应的例外规定,并从中找到一些共同点,为我国的进口商提供一些对策。

Parallel imports is long topic,but now there is still not uniform solution of this problem,and different attitude to it between different countries.With the development of international trade and economic integration,china will encounter more cases of parallel imports.How to settle such a sensitive and complicated problem and protect our benefits as more as possible will be a topic.This thesis will try to give several suggestions to Chinese importers based on the regulations and cases of developed countries.
