摘要
善意取得制度,为近代以来大陆法系与英美法系民法的一项重要法律制度,其内容涉及民法财产所有权静的安全与财产交易动的安全的保护问题。传统民法理论认为该制度适用范围仅以动产为限,文章对此持相反立场,并从不动产善意取得的存在依据、构成要件、适用范围等多个角度阐述了对该制度的看法,指出不动产亦可适用善意取得制度。
Bona fide acquisition system is very important in British-American legal system and continental legal system. Generally speaking, the personal property is considered to suit the bona fide acquisition system only. This article is opposed to this view. It is also necessary for the real estate to suit the bona fide acquisition system in consideration of the following aspects: the theoretical basis, the components, the applicable scope, and so on.
