摘要
警察法学是以警察法为对象,研究其法律规范、体系、作用以及发展规律的法学学科,而警察法则是所有调整国家警察机关在行使警察权力过程中发生的各种社会关系的法律规范的总称。应当确立警察权在警察法学基础理论中的独立地位,同时构建警察权的理论体系,包括其权力的内部结构、外部结构和法律结构。内部结构是警察权的构成要素:法律要素、主体要素和职责要素;外部结构是权力的种属结构,即权力可分为:总权力、类权力、权力项;法律结构分为三层:即《人民警察法》、其他法律法规的有关规定、实施细则。
Police law is a law subject of studying its law regulations,system,function and development rules with the law of police as object.The law of police is the summary of all legal regulations used for adjusting all kinds of social relation during the course of national police organs exercising their power.The independent status of police power in the basic theory of police law should be established.In the mean time,we should also build the theoretical system of police power including the inner structure,outer structure and legal structure of the power.Inner structure is the element of police power:legal element,subject element and duty element.Outer structure is the species structure of power,that is to say the power can be divided into general power,species power,power items.Legal structure can be divided into three levels:'the Law of People's Police',related regulations of other laws,implementation rules
