行政自由裁量权是当代行政发展的重要特征和趋势,自由裁量权在发挥其能动性的同时,极有可能被滥用,对行政相对人的合法权益造成侵害。本文试就行政自由裁量权的存在、错位及如何对自由裁量权进行监督与控制作一探讨。

Administrative right of free decision and judgment is an important feature and tendency in modem administration devel- opment.While this right is brought into play,it is more likely to be abused,thus to hurt the lawful rights of the connected persons. This paper is to probe the existence,the dislocation of the administrative right of free decision and the way how to supervise and control this right.
