The Research on the Power Forms When the Competitive Law is Enforced

竞争执法主要有反垄断与产业监管两种形态。反垄断机构与产业监管部门作为执法的实施者,不同的权力安排决定了对市场矫正的效果差异。产业监管与反垄断的相对独立管辖及协调机制,越发成为较优的模式安排。中国市场竞争秩序构建中,反垄断机构与产业监管部门的权力形态安排可借鉴这一经验,但不能脱离自身的特殊性。

There are two forms when the competitive law enforced:the counter-monopoly and the industrial regulators.The counter-monopoly organization and the industrial regulators enforce the law.The different arrangements of the power make the different effects to the market.The range of the industrial supervising and managing and the counter-monopoly should be made clear and worked coordinately.This mechanism becomes to be a better choice.During the construction of market competitive rules,the arrangement of the power forms of the relative departments should be used this mechanism for reference.We must realize the particularities as we learning the useful experience.
