银行保管箱业务是改革开放以来的一项新兴业务,对此业务开展基于何法律性质从一开始就存在争议,是租凭、保管、委托、仓储还是作为非典型合同有待进一步研究,本文对此问题依据民法通则、合同法、商业银行法、司法解释等精神,同时参照国外的相关法律以及实务进行研究。

The store kit businness in banks is a new business since the open policy.And there exists dispution on the base law eversince:rent,storage,entrustment,or a non-typical contract for further study?This thesis analyes this problem basde on Priciples of Peoples Law,Law of Contract,Law of Commercial Bank,and judical explanation together with some related laws from foreign countries.
