摘要
教唆自杀,是指故意采用引诱、怂恿、欺骗、促成等方法,使他人产生自杀意图并进而实行自杀的行为。通过对世界各国刑法对教唆他人自杀行为的立法规定和定性争议的梳理,并在分析我国学者对此问题见解的基础上,对教唆他人自杀行为进行理性反思,应当细化故意杀人罪的罪名,增设关联自杀罪,使追究教唆他人自杀行为刑事责任有法可依。
By analyzing the legislative regulation and qualitative controversy of the behavior of inciting others to commit suicide throughout the world,and discussing different scholars' views on it in our country,I think it is necessary to analyze this behavior rationally,subdivide the charges of the murder charge and establish the related suicide offense.Therefore,there would be corresponding laws to investigate the criminal responsibility for this behavior.
