针对行政主体所做出的无效行政行为,许多国家都有专门的确认无效诉讼制度向相对人提供救济。作为确认诉讼中的一个类型,确认无效诉讼拥有其独立的地位与价值。我国现行的《行政诉讼法》中还没有关于确认诉讼的规定,而关于无效确认诉讼的规定也仅在《行政诉讼法若干问题解释》增设确认判决时有所涉及。但这些条款并不能说明我国已经拥有了独立的确认无效诉讼制度。确认无效诉讼的独立性主要体现在其特别的规则上,应借鉴德国模式,将确认无效诉讼与撤销诉讼看作是两种并列的诉讼类型。
