实现法制现代化已经成为我国的重要目标,但怎么样实现法制的现代化却有不同的看法,有学者提出“本土化”,有学者提出“法律移植”,这样的争论往往是在宏观的层面上来进行,都提出了支持己方的理论。针对这一情况只能在不同的法律部门和具体的法律规则之中分析和研究是否“本土化”还是“法律移植”,才能找到实现法制现代化的途径,无限放大和泛化某一种学说和理论都不可取,对我国法制现代化建设都是有害的。
