摘要
惩罚性赔偿是英美法系侵权法中一项古老的制度,其在我国的国家赔偿法中还处于缺位状态,有必要将其纳入到国家赔偿中来,即构建补偿性赔偿和惩罚性赔偿并用的二元赔偿标准,在“故意和重大过失”的情形下,追加适用惩罚性赔偿。
The punitive damage is an old system in the tort law of the Common Law System,while hasn't been set up in our state compensation law.We can adopt the dualistic compensation standard——compensatory damages and punitive damages——in the state compensation law.In the case of "intent or serious blame",we can apply the punitive damage in addition.
