上世纪末,随着法治国家的思想入宪,学界通说对依法治国的标志可以概括为立法上要求有完备的法律体系,执法上要有严格的执法制度,司法上要有公正的司法制度,守法上要有健全的公民法治意识,但随着理论的深化和社会的发展,作为法治标志的立法、执法、司法、守法四个方面出现了新的趋势,我们应从这些新的趋势中探求法治标志的新动态,以期完善法治标志的理论体系。
