“目的和效果”方法是指WTO专家组或上诉机构在同类产品/同类服务认定案件中,欲意通过对成员方区分产品/服务的相关措施的目的和效果的考察,以认定相关产品/服务是否具有“同类性”的方法。在以往WTO争端解决实践中,“目的和效果”方法的适用存在较大的争议,不同案件的专家组或上诉机构对此观点不一,甚至截然相反。学界也对其适用是否具有规范基础、是否违反条约有效解释原则等问题展开激烈的探讨。
