摘要
柏拉图、亚里士多德的正义论奠定了西方人本法治观的基础;罗马人对人本法治观的传承与创化;中世纪神学背景下的法治理念强调人的救赎与反生态主义,随着上帝之死与理性王国的建立,近代以降的法治发展道路彰显了以大功利生存解释方式为主导的科技人文法治观;20世纪70年代的全球性生态危机使人类开始彻底反思自亚里士多德以来的人本法治史。于是,一种理想的法治观念模式——生态法治观,在上述历史背景下的脱颖而出成为必然。
