证人作证问题是民事诉讼的基本问题,也是民事诉讼言辞中心主义的关键所在。关于证人拒绝作证其实是个价值衡量的问题,在涉及案件事实与其他价值冲突时是否一味追求真实,如何处理也值得探讨。证人拒绝作证不是因为其本身有什么特权,而是因为其负有对相关人的保密义务(如医生对病人负有保密义务),所以准确地说应该叫证人拒绝作证的义务。
