论我国反商业贿赂法律责任体系的不足与完善——以《联合国反腐败公约》为参照

商业贿赂遍及我国社会经济诸多领域,已成为经济社会生活中的一大公害,其根治刻不容缓。然而,我国反商业贿赂法律责任机制存在明显缺陷。作为《联合国反腐败公约》的缔约国,我国现行治理商业贿赂的法律体系与《公约》相比仍存在一些差距,不符合国际通行规定,也在一定程度制约了治理商业贿赂工作的开展。参照《公约》的相关规定,尽快完善反商业贿赂法律责任体系,不仅是我国法制建设的需要,而且是构建反商业贿赂长效机制的积极举措。
