对我国被害人诉讼地位之反思与展望

Reflections and Prospects on the Victims' Status in Litigation of Our Country

被害人在刑事诉讼中居于何种地位,与诉讼模式的构造、诉讼权利的分配以及诉讼程序的设置等诸多因素密切相关;厘清并合理确立被害人的诉讼地位不仅是被害人制度研究的一个核心问题,更应成为整个刑事诉讼研究的基本问题。分析我国现行被害人制度所存在的缺陷和弊端,并对此加以反思,进而对重新构建我国被害人诉讼地位作出适当展望,以使被害人的诉讼地位更加科学化、合理化,应是被害人制度研究的当务之急。
