论发展权视野中农地产权保护的法律机制

The System of Protecting Title of Countryside Land

农地产权制度确立不仅是农民财产权益保障的起点和基石,也是市场经济发展的必然要求,更是统筹城乡发展,促进社会主义新农村建设的关键举措。然而现实中违法征用土地现象严重,农地产权保护中主体虚位、产权虚置,权能残缺,国家对农地发展帮助权也存在缺位,严重损害了农民的主体性发展。建设社会主义新农村,促进农民发展,必须科学设置农地产权制度、完善村民自治、保障农民结社权、强化司法救济,为农地产权保护提供制度、政治、组织乃至司法保障;同时必须规范土地市场,保障土地合法流转。
